Attention! New Yorkers!

Based upon feedback I received from our Dutchess County Sportsman's Federation Rep. This bill has already passed in the state house and will be going forward to the state Senate for vote very soon. Actually, they are combined two bills that will move the regulatory control of trapping including additional permits, fees and restrictions to the local municipalities. The bill is being sponsored by (you guessed it!) representatives from Queens, Staten Island, Long Island, Brooklyn. This is non-sense. But what it will do is further restrict ALL of our rights throughout the state regarding trapping. Also realize that this would be a major precedent! If these bills pass, it opens the door to further regulations and restrictions on hunting and fishing too! I urge you to please write to your state senators and assemblyman and voice your disapproval regarding these anti-trapping bills.

Here is the reply I received from Assembly Joel Miller in my District. Also below is the role on voting in the State Assembly back in May, so you can see how your Assemblyman voted. It has yet to go to the State Senate. Please write to your state senator and express your opposition to this bill.

Dear Mr. McDonald,

This is in response to your email regarding Assembly Bill A1835, allowing counties to enact a local law to restrict limit or prohibit trapping within the municipality.  Thank you for taking the time to write and advise me of
your views and concerns.

In spite of the tragic nature of this accident, I still believe that the determination of trapping policy should remain a statewide determination. The Department of Environmental Conservation has the expertise to evaluate
based on merit.  All too often small well organized groups can apply enough pressure at the local level to put into effect regulation, rule or laws that fall short of the best possible solutions.
 
This piece of legislation passed the Assembly on May 22, 2006 Yea's 89 and Nay's 54.  Please note on the enclosed bill that I voted in opposition of this bill.

        AN ACT to amend the environmental conservation law, in relation to

          The  People of the State of New York, represented in Senate and
Assem-
        bly, do enact as follows:

     1    Section 1. The environmental conservation law is amended by
adding  a
     2  new section 11-1111 to read as follows:
     3  § 11-1111. Municipal regulation of trapping.
     4    Notwithstanding  any  other  provision of this article or of any
other
     5  law, rule or regulation, each county in the state may, by local  law
or
     6  ordinance,  restrict,  limit  or  prohibit trapping within its
municipal
     7  limits. No provision of this section shall be  deemed  to  prohibit
the
     8  department  from  exercising  its  emergency  powers pursuant to
section
     9  11-0325 of this article in relation to the control of fish  or
wildlife
    10  in the public interest to prevent the introduction or spread of
disease.
    11    § 2. This act shall take effect immediately.

TITLE OF BILL:  An act to amend the environmental conservation law, in
relation to municipalities regulating the use of traps


PURPOSE OR GENERAL IDEA OF BILL:  To allow counties to enact a local
law to restrict, limit or prohibit trapping within the municipality.


SUMMARY OF SPECIFIC PROVISIONS:  The environmental conservation law is
amended by adding a new section to allow counties to enact local laws
more rigid than state laws regarding trapping.


JUSTIFICATION:  Currently, three counties across the state have
enacted local laws to impose more limits on the use of traps throughout
their counties. The state has challenged these laws passed in Suffolk
and Rockland counties and has been upheld in court because the authority
to regulate trapping on other than county property is only granted to
the state. Legislation is necessary so that counties may place limits on
trapping without fear of state intervention. The DEC has failed to
respond to the changing demographics of those different counties. This
bill would place the decisions in the hands of county legislatures as to
how much if any trapping should be allowed in the county.
