It must be maddening to have to wait while someone is on vacation, but the wheels of the law turn very slowly, and you just have to hang in there.  I would imagine that everyone involved other than you just wishes it would go away, so you have to be willing to keep the wheels moving all by yourself.  I hope for the sake of my dog and all the other dogs that could one day be in the same situation that you are able to keep the wheels turning.  If you end up with a misdemeanor, that would be a victory.  It might keep him from doing it to the next dog where it would be a felony.

Just read this and it is infuriating. So sorry for the loss of your dog and the injury of the other...how is that one doing with recovery?
Be patient, but be persistent. Your so-called "neighbor" can't just open fire on dogs no matter what his story. The fact he shot both of them is also incriminating and shows a vicious streak on his part.
Justice will prevail. In the mean time, you have my sympathy.

A little more backstory on this guy. He has shot at people that were searching for a deer on my neighbors property. Not his property, but another neighbors property. He has also told my neighbor that he has watched him in his scope while he was on his tractor. These people have all agreed to testify against him if this makes it to court for criminal charges.

You really need to locate these people and see if they would be willing to come forward to the Prosecuting attorney with their experiences. Shooting at people is a crime an shows a definite predisposition for violence and would carry a lot of weight.

I'll always remember early in my Law Enforcement career, I went on a call of a man who shot a dog. Turns out he was a construction worker on a job site in the country where some local dogs figured out if they went to the construction site at lunch time, the workers would feed them goodies. Anyway, this fellow who had partaken in feeding the dogs for days had just poured a driveway. Here comes the Irish setter......you guessed it....right across the new pour. This guy was so enraged he got a .44 mag out of his truck and shot a front leg off the setter. The other workers were ready to string him up and he had to make a hasty getaway.
That bonehead ended up paying dearly for being an ass. He actually thought I could not arrest him if he met with me on the other side of the county line. :biglaugh:I would stop in occasionally and pet that dog for some years afterward if I was in that part of the county and saw him out. He got around pretty well on three legs. Great dog. Sorry for your loss.

shooting dogs in Missouri is pretty common, since people with cattle are protected under .(protecting their livleyhood). and they use it as an excuse to just shoot any dog on their property weather they are messing with the cattle or not.

You mentioned lawyer, may be your best bet.  Cost money, let us know and we will get the ball rolling.  Can't spend to much to prosecute the SOB.  I am an old man with not a lot of time left, no one to leave my stuff to so I will stand for $500. if needed.

I am hoping to hear back from the sgt. tomorrow sometime.  I'm ready to know something for sure about what they intend to do with this guy.  I have a feeling that they won't charge him with anything, but you never know unless you push the issue.  On a more positive note, my dog that survived is doing very well.  He has started to put a little bit of weight on his leg that was operated on.  He seems to be getting around extremely well on 3 legs for now.  It won't be long and he will be back to normal.

In most states dogs are considered property. At the very least he should be responsible for the replacement cost of the one and medical costs for the other. Hope he gets more

I may have missed it, but, did your dog lose it's leg? 


I would have a hard time sleeping knowing someone like that lived close.  There is no limits to what someone like that will do.  If he has shot at a human on wouldn't that be attempted man slaughter? 

Either way, I would have a burning anger that isn't very beneficial.  I will echo what everyone else has said and what you seem to be doing, don't take justice into your own hands.  A lot of times the law doesn't work out our way.  Although it sucks, we can't do much about it and still be a good husband and father.  I hope justice is served.

No, my dog did not end up losing his leg.  Had he gotten an infection after the operation, chances were good they would have to amputate part of it.  But he is doing quite well now.  I don't know how, but he has already been putting quite a bit of weight on it and was trying to run earlier today while I had him out on his leash. 

The reason that he didn't get in trouble for shooting at people before was because it was dark and the people that got shot at couldn't actually see him.  They could hear the bullets in the trees, but since there were no witnesses nothing could be done.  That's what was told to me by an officer that dealt with it.

Sorry for your loss.  Our dogs are like our children, and that is why we have our property mostly perimeter fenced near the house, in order to keep them off of the neighbor's property.  In Oklahoma, you are allowed to shoot stray dogs if they are harrassing your livestock, and tons of people have cattle.

In fact, I have been on the other end of this, when roaming pit bulls tore up a horse of mine, and if you report it, they tell you the dogs aren't licensed and nobody will claim ownership and pay for the damage.  It makes people less tolerant of the next dog they see around their livestock.
